Terms of Service

These terms are an agreement between you and nmCollector.net LLC, a New Mexico limited liability company ("we", "us"). They cover NM Collector CP on Windows, Mac, Linux, Android and iOS, activation keys, and purchases made at nmcollector.net. By installing or using the software, you agree to these terms.

If you get the app through Google Play, the Apple App Store or the Microsoft Store, that store's own terms also apply to the download. Where they conflict with these terms on the download itself, the store's terms win.

1. License

We grant you a personal, non-exclusive, non-transferable license to install and use NM Collector CP on any devices you own or control. You may not resell, sublicense, or redistribute the software or activation keys, or reverse engineer the activation system.

Free trial. Every feature is available free for 30 days. No account or payment details are needed.

Free version. After the trial, the software keeps working with a reduced feature set. Your data is never deleted or locked.

Activations. An activation key unlocks all features for the period you buy: 1, 2 or 5 years, or lifetime. Activations never renew automatically. When a term activation ends, the software returns to the free version and your data stays intact.

Activation follows your database. The activation is tied to your collection database, not to one device, so it works wherever you use that database.

Lifetime means for the life of the major version you activate, as described under Updates.

2. Purchases, refunds and updates

Prices are shown in US dollars on the Shop page at the time of purchase. Payments are handled by our payment provider; we do not store card details.

Delivery. Activation keys are delivered by email.

Refunds. Because every feature can be tried free for 30 days, activations are not refundable once delivered. If your key does not work, contact us and we will replace it or refund your purchase. Physical items are covered by our Return Policy.

Updates within the same major version are free. A new major version may require a new purchase, and you may keep using your current version indefinitely.

Retail purchases (for example through Brownells) are also subject to that retailer's terms.

3. Your data

Your collection data belongs to you and stays on your devices. The software does not connect to the internet, collect usage data, or send anything to us. See our Privacy Policy.

Because we never have access to your data, we cannot recover it. You are responsible for keeping backups. The software makes an automatic backup each time it starts, but you should also keep copies on separate media. If you move data by email or a cloud service, that provider's terms and security apply.

4. Warranty and liability

No warranty. To the extent the law allows, the software is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not promise the software will be error-free or uninterrupted.

Your records are your responsibility. Reports and templates, including firearm acquisition and disposition formats, insurance inventories, and estate records, are tools to help you. You remain responsible for the accuracy of your entries and for meeting any legal, regulatory, insurance, or record-keeping requirements that apply to you. Values in the software are your own estimates, not appraisals.

Limit of liability. To the extent the law allows, we are not liable for any indirect, incidental, special, or consequential damages, or for lost data, profits, or records. Our total liability for any claim is limited to the amount you paid us for the software in the 12 months before the claim.

Consumers in the EEA, UK and elsewhere. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived by contract. Where such laws apply, the limits above apply only as far as those laws permit.

5. Governing law, changes and contact

Governing law. These terms are governed by the laws of the State of New Mexico, USA, without regard to conflict-of-law rules. Consumers keep any mandatory protections of the laws where they live.

Changes. We may update these terms. The date at the top shows the latest version. Changes do not affect activations already purchased.
